These Terms of Service ("Terms") govern your use of Nestlio and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility and Account
You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when creating an account.
2. The Service
Nestlio is a platform that enables housing seekers and real estate agents to connect regarding rental and housing opportunities.
Nestlio is not a real estate broker, landlord, property owner, legal advisor, financial advisor, or party to any agreement between users.
We do not guarantee the availability, quality, legality, safety, suitability, or accuracy of any housing opportunity, listing, request, or communication on the platform.
3. User Accounts and Roles
Users may register as housing seekers, agents, or other account types offered by the Service.
You are responsible for all activity conducted through your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Paid Features and Payments
Certain features of the Service may require payment.
Payments are processed securely by third-party payment providers such as Stripe.
We do not store or have access to your complete payment card information.
Prices, subscription plans, and billing terms will be displayed before purchase.
Subscriptions and Cancellation
If you purchase a subscription, it may automatically renew unless cancelled before the renewal date.
You may cancel your subscription at any time through your account settings.
Unless required by law, payments already made are non-refundable.
5. User Content
You retain ownership of the information and content you submit to the Service, including housing requests, property information, messages, images, and profile information.
By submitting content, you grant Nestlio a limited, worldwide, non-exclusive license to host, store, display, process, and distribute that content solely for the purpose of operating and improving the Service.
You are solely responsible for your content.
6. Acceptable Use
You agree not to:
- Post false, misleading, fraudulent, or deceptive information.
- Impersonate another person or organization.
- Violate applicable laws or regulations.
- Upload harmful, abusive, discriminatory, or illegal content.
- Collect user information without authorization.
- Interfere with the operation, security, or integrity of the Service.
- Use automated tools to scrape or harvest platform data without permission.
7. Communications Between Users
Nestlio provides tools that allow users to communicate with one another.
We are not responsible for the conduct, statements, promises, agreements, or actions of users.
Users are solely responsible for evaluating opportunities and conducting their own due diligence.
8. Intellectual Property
The Service, including its software, design, branding, content, and technology, is owned by Nestlio and its licensors.
Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Service.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Nestlio disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Nestlio and its operators shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.
Our total liability for any claim shall not exceed the amount you paid to the Service during the twelve months preceding the event giving rise to the claim.
11. Termination
We may suspend, restrict, or terminate your access to the Service at any time if you violate these Terms or if we reasonably believe your use may create risk, harm, liability, or legal exposure.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Japan, except where applicable law provides otherwise.
13. Changes to These Terms
We may update these Terms from time to time.
If material changes are made, we will update the "Last updated" date at the top of this document.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
